The election of Prime Minister Peter O'niel on December 12 Last year is unconstitutional, invalid and of no effect. These were statements from a majority Supreme Court Judges ruling of 3 - 0 yesterday evening.
Two other judges, Justice Salika and Justice Sakora refused to have their opinions published. The judges who handed down their decision include Chief Justice Salamo Injia, Justice Kirriwom and Justice Nanua.
The Majority ruling was that:
- re-election of Oniel was in breach of binding opinion and declarations made on December 12, 2011. Parliament should have allowed for Sir Michael resume his seat
- also the new amendment on prime ministers age limit was unconstitutional
- court also ruled it was unconstitutional for the GG to recognize Somare than retract and recognize Oniel.
Based on last nights Supreme Court Outcome Oniel is calling a special parliament session this morning at 10 am to resolve the matter.
The Grand Chief Sir Michael Somare will issue a statement today but as of last night said that based on the court outcome it would be illegal for Oneil to recall parliament and all actions by oniels government has been unconstitutional.
One good thing is that both sides are saying that Polls will go as scheduled.
